These terms are the agreement between you and TruStar LLC ("TruStar", "we") for using the TruStar app and website. By creating an account or using the app you agree to them and to our privacy policy. Each contest also has Official Rules shown in the app; if they conflict with these terms for that contest, the Official Rules win.
You must be 18 or older and a legal resident of the United States to enter contests, vote or receive prizes. You may hold one account. Accounts are personal and may not be sold, shared or transferred.
Keep your sign-in details private; you are responsible for what happens under your account. To make voting fair we may require you to verify a mobile phone number, and one number can verify only one account. Tell us at support@trustarapp.com if you think your account has been used without your permission.
You agree not to: create or control more than one account; use scripts, bots, emulators, modified apps or paid services to cast or obtain votes; trade or buy votes; interfere with other users' accounts; misrepresent who you are or what you own; or post content you do not have the right to post. We use technical measures, including device attestation and pattern detection, to enforce this. Breaking these rules can mean voided votes, lost entries, forfeited prizes and a closed account.
You keep ownership of the videos and other content you post. You give TruStar a worldwide, royalty-free licence to host, store, reproduce, adapt (for example, to create thumbnails, previews and watermarked share clips), display, distribute and promote your content in connection with the app, contests and TruStar's marketing, for as long as the content is on the service and for a reasonable time afterwards in materials already made. You confirm you have all rights needed for everything in your content, including music, and that it does not infringe anyone's rights.
You must not post content that is illegal, hateful, harassing, sexually explicit, violent, deceptive, or that infringes someone else's copyright or privacy. We may remove content and suspend accounts that do, and we respond to copyright notices sent to support@trustarapp.com.
Prizes are paid to the account holder of a winning entry after the contest ends and any review is complete, using the payout method you provide in the app. You are responsible for all taxes on prizes. Where required by law we will ask you for a completed IRS Form W-9 before paying and will issue a Form 1099; we may withhold a prize until we have it. Prizes unclaimed, or not payable because required details were not provided, within 90 days of a request from us may be forfeited.
We work hard to keep TruStar running, but it is provided "as is" and "as available" without warranties of any kind. We may change, pause or end features or contests, with notice where practical. We are not responsible for content posted by users.
To the fullest extent the law allows, TruStar and its owners, staff and partners are not liable for indirect, incidental, special, consequential or punitive damages, or lost profits or data, arising from your use of the service. Our total liability for any claim is limited to the greater of $100 or the fees you paid us in the twelve months before the claim. Some states do not allow these limits, so some may not apply to you.
You can stop using TruStar and delete your account at any time by emailing support. We may suspend or close accounts that break these terms or the Official Rules, or where the law requires. Sections about content licences, prizes, liability and disputes continue after an account closes.
These terms are governed by the laws of the State of Texas and the United States, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Texas, and you consent to their jurisdiction. Please contact us first; most issues are solved with an email.
We may update these terms. We will post changes here with a new effective date and, for material changes, notify you in the app before they take effect. Continuing to use TruStar after that means you accept the new terms.
